Terms and Conditions and Comprehensive Digital Liability

First: Definitions

Agreement:
These Terms and Conditions constitute a binding agreement regulating purchases through the online store or the official social media accounts.

Store:
Dar Al-Zouq Boutique, an establishment operating in the United Arab Emirates.

Website:
The official online platform and all its associated pages.

Official Accounts:
Authorized social media accounts of the Store.

Customer / User:
Any natural or legal person using the Website or official accounts to complete a purchase.

Products:
All goods offered for sale through the Store.

Completion of a purchase constitutes final and binding acceptance of these Terms.

Second: Eligibility

The User acknowledges having full legal capacity to enter into electronic contracts under the laws of the UAE and bears responsibility for the accuracy of the provided information.

Third: Order and Purchase Process

• An order is not binding until official confirmation is received.

• The Store reserves the right to refuse or cancel any order in the event of:

  • Suspected fraud.

  • Technical or pricing errors.

  • Product unavailability.

  • Violation of these Terms.

• In case of cancellation, the Store’s obligation is limited to refunding the paid amount only.

Fourth: Prices and Payment

• All prices are in UAE Dirhams (AED).

• An order is not considered complete until payment has been successfully processed.

• The Customer bears any additional bank or processing fees.

Fifth: Shipping and Delivery

• Shipments are made via official channels or approved shipping companies.

• The Store is not responsible for delays caused by shipping companies, official regulations, or force majeure events.

• Product risks transfer to the Customer upon delivery to the shipping provider.

Sixth: Official Accounts and Social Media

The Store manages official accounts on:

• Instagram

• Facebook

• Snapchat

• TikTok

• X

Any account not officially announced shall not be considered valid.

Seventh: Nature of Images and Visual Content

1. Models’ Images:
   Marketing materials may include images of models that are:

• Created using digital tools or AI technologies.

• Obtained from licensed libraries.

• Digitally modified.

2. Scope of Use:
   Images are used solely for illustrative and marketing purposes.

• They do not imply any contractual relationship with the persons depicted.

• The Store does not claim personal rights to any person in the images unless explicitly stated otherwise.

3. Precautionary Clause Regarding Image Rights:
   If any party makes a claim regarding the use of an image or persona, the burden of proof rests entirely on the claimant to demonstrate:

• Legal standing.

• Exclusive ownership of the claimed rights.

• Absence of license or permission for use.

• Direct and actual damage resulting from the act.

The Store’s liability shall not exceed the actual value of the usage in dispute under UAE laws.

Eighth: Intellectual Property

• These Terms are subject to UAE copyright and related rights laws and any supplementary legislation.

• All branding elements, logos, presentation styles, artistic treatments, and composite designs are the exclusive property of the Store.

• Exceptions to exclusive ownership include images:

  • Obtained from licensed platforms.

  • Created using AI tools.

• The Store’s rights are limited to commercial use of the final composite design.

Ninth: Limitation of Liability

• The Store’s maximum liability under any circumstances is limited to the value of the product only.

• The Store is not liable for indirect, consequential damages, or loss of profits, without prejudice to legally guaranteed consumer rights.

Tenth: Indemnification

The User agrees to indemnify the Store against any claims arising from:

• Misuse of the website.

• Republishing images out of context.

• Violation of applicable laws.

Eleventh: Force Majeure

The Store shall not be liable for any failure resulting from circumstances beyond its control, including natural disasters, government decisions, or technical failures.

Twelfth: Governing Law and Jurisdiction

• These Terms are governed by the laws of the United Arab Emirates.

• The courts of Dubai have exclusive jurisdiction over any dispute arising from the application or interpretation of these Terms.

Thirteenth: Severability

If any provision is deemed legally unenforceable, the remaining provisions shall remain in full force and effect.
